All material is guaranteed to be as specified.  All work to be completed in a workmanship like manner according to standard practices.  Any alteration or deviation from original specifications involving extra costs will be executed only upon written orders, and will become an extra charge over and above the estimate.  All agreements are contingent upon strikes, accidents or delays beyond our control.  Customer understands that 50% DEPOSIT  IS REQUIRED TO PLACE ORDERS AND THE REMAINING BALANCE SHOULD BE PAID IN FULL BEFORE IT IS RELEASED.  Customer understands there is a $25.00 fee for all payment checks that are returned due to insufficient funds.  Customer understands that there is a 30% RESTOCKING FEE PLUS FREIGHT ON ALL CANCELLED ORDERS THAT HAVE BEEN CUT AND/OR SHIPPED.  Customer will be charged $25.00 plus tax per carpet sample.  If samples are lost, damaged, or checked out over two weeks.  This charge for samples is nonrefundable.  NO CREDIT, REFUND, OR EXCHANGES ON STOCK RUG PURCHASES AFTER 24 HOURS.   Customer understands and agrees to the Terms and Conditions.

 

Please inspect carpet at time of delivery. Verify carpet received is what was ordered.  No claims will be considered on visible defects (wrong color, wrong carpet, streaks, carpet damaged during shipping, etc.) after carpet has been cut or installed.
All claims for irregular carpet must be made within five days after receipt of goods.
No goods may be returned for credit unless by written authority from the main office.
Buyer understands that there may be a dye-lot variation from sample to sample.
All prices are subject to change without notice.  Should prices change, unfilled orders will take the terms of the new announced price to be cancelled.
Seller is not responsible for manufacturer or shipper delays.
Payment in full to be made at time of order, unless otherwise noted.  There will be a service charge of 1.5% per month (an annual percentage rate of 18%) charged on all invoices unpaid after due date.
In case of non-payment, Myers Carpet reserves the right to pursue all money owed to Myers Carpet plus legal fees and other expenses according to applicable laws.
No claims will be considered on goods sold as mill trials, seconds, imperfects, mill ends or remnants.
Carpet especially made to buyer’s specifications is not subject to cancellation.
Cancellations will not be considered on any orders for which carpet has already been cut  and/or shipped.  Buyer agrees to pay added restocking charge and/or freight charges for such orders.
All claims for goods lost, stolen or damaged in transit must be made against the transportation company.  When receipt from transportation company is received our responsibility ceases.  Any claim for damages in transit should be made immediately to the agent at point of delivery.  Inspect the wrapper of the carpet at time of delivery.  If torn, or dirty, note the condition of the wrapper on the bill of lading.  The original wrapping must be saved to file a freight damage claim with the freight company.
Seller is not responsible for customer measurements.
One year labor warranty on custom or stock rugs crafted in our warehouse.
Seller not responsible for damaged custom rugs left in our warehouse over 30 days.  No claims will be considered on such rugs.  It is the responsibility of the customer to pick up or arrange for delivery of rugs once completed.  Rugs left over 30 days will be accessed a storage fee.
